1. General terms and definitions
1.1 These General Terms and Conditions (hereinafter referred to as “T&C”) relate to the business relationship between the buyer and the company Home AZ, s.r.o., operating Karpatske namestie 10A, 831 06 Bratislava, Slovak Republic, ICO 52 235 041 (hereinafter referred to as “operator” or “seller”) concluded through the electronic store system www.home-az.com

1.2 T&C regulates the rights and obligations of participants in a distance purchase contract through the online www.home-az.com server between the seller and the buyer.

1.3 In the case of concluding a consumer contract within the meaning of Section 52 et seq. Of the Civil Code, concluded with the use of means of distance communication, the contractual relationship between the buyer and the seller is governed primarily by Act No. 102/2014 Z.z. on consumer protection in the sale of goods or services on the basis of a contract concluded at a distance or contracts concluded outside the premises of the seller and amending and supplementing certain acts, the Civil Code and Act. no. 250/2007 Z.z. on Consumer Protection and on the amendment of the Act of the Slovak National Council no. 372/1990 Coll on offenses as amended.

1.4 As a buyer (customer), in the system a registered person who sent after his / her own authorization an electronic order, processed by the system of trade www.home-az.com, and whose purchased goods or benefits in kind do not serve for the performance of employment, occupation or acting within the scope of his business activity .

1.5 By electronic order is meant sent electronic form, containing information about buyer, list of ordered goods from e-shop offer and price of these goods, processed by system of shop or e-mail sent to seller’s address, containing information about buyer (name and surname, full exact address e-mail, telephone number), subject of performance – name of goods, quantity and its price, place of delivery. In the event that the goods are taken over by a person other than the buyer, it is desirable to send that person’s identification data. We also accept orders by phone or in writing, and include all of the above.

2. Order and purchase contract
2.1 The condition of the order validity is a true and complete filling of all the required data and requisites with the registration form, including telephone contact.

2.2 All accepted orders are considered binding.

2.3 A contract online means a contract between the seller and the buyer agreed and concluded exclusively by means of remote communication without the simultaneous physical presence using a website, e-mail, telephone, and the like. A contract for the sale of goods means a contract under which the buyer acquires the object for consideration, in particular a contract of sale. The purchase contract, on the basis of which the sale of goods is realized, is based on a binding confirmation of the order in the system. The order confirmed by the seller (or part thereof) is considered binding for both parties if the conditions agreed at the time of confirmation are not violated and the relationship between the buyer and the seller arises.

2.4 Essential conditions agreed at the time of confirmation are mainly the content of the order (exact specification of the goods and its quantity), the price for the goods and transport, the method of delivery, the method of payment for the goods, full identification of the buyer.

2.5 The buyer undertakes to take over the ordered goods and pay the agreed price for it, with which it is explicitly notified before sending the order, by the wording “I am aware that the order is subject to the price obligation” when creating the order.

3. Order cancellation
3.1 The buyer has the right to cancel the order without giving any reason at any time prior to the seller’s binding confirmation. After a binding order confirmation only if the seller does not meet the agreed delivery terms. In the event of cancellation of an already confirmed order, the buyer is obliged to pay the seller the damage caused by such action. In particular, the Seller shall exercise the right to damages in the case of the purchase of goods “on demand”, which had to be made according to the specific requirements of the buyer or the goods specified separately for one buyer or where demonstrable costs were already incurred in relation to the seizure of the goods.

3.2 The seller reserves the right to cancel the order or part thereof in the following cases:
– in the case of cash on delivery order, which could not be committed (wrong phone number, unavailable, not replying to emails, etc.)
– the goods are no longer produced or delivered or the price of the supplier of goods has changed significantly. If this happens, the seller will immediately contact the buyer to agree on further action. If the buyer has already paid part or all of the purchase price, the amount will be transferred back to his account or address within 14 days.

4. Pricing conditions
4.1 Product price includes 20% VAT

4.2 Prices of postage and packing are specified in point 5 of these T&C

4.3 The buyer has the option to pay in the following currencies: EUR, USD

5. Postage and packing
5.1 Home AZ, s.r.o. does not charge packaging.

5.2 The postage price is inclusive of VAT and is determined from the resulting order amount for all discounts.

5.3 Postage is not charged if you pick up goods in Bratislava

5.4 We offer postage to all European Union countries

6. Terms and conditions for payment for goods
6.1 One-time transfer from your account to Home AZ, s.r.o. listed in the mail notification. In the case of a transfer payment, the buyer receives an extra 1 Euro discount.

6.2 By paying cash on delivery

6.3 By cash at company headquarters based on invoice

6.4 By Payment card via e-shop home-az.com

6.5 If the price for the delivered products is not paid in full, the Seller has the right to interrupt further deliveries of goods until the price is paid.

7. Terms of Delivery
7.1 Deliveries of the subject of performance (ordered goods) will be dispatched as soon as possible according to the availability of the products and the operational possibilities of the seller. For each product, the availability of the goods is indicated.

7.2 Every customer is informed of any changes in the order status by email. Order status can be checked by logging in to the system.

7.3 The goods are delivered via Slovak Post or DPD to the address given by the customer in the order. A package with goods always contains an invoice.

7.4 The goods are also available for personal collection at Home AZ, s.r.o. after mutual agreement.

7.5 Ownership right to the products passes to the buyer by taking over and paying the purchase price.

7.6 We deliver the goods to all European Union countries.

8. Warranty Conditions and Complaints Procedure
8.1 This Complaints Procedure applies to goods purchased from Home AZ, s.r.o. and whose claim was made within the warranty period of 24 months from the date of purchase.

8.2 For every item purchased from Home AZ, s.r.o. is delivered to the buyer with an invoice (sales receipt), which also serves as a guarantee document.

8.3 When taking over the goods, the buyer is obliged to check the following:
* if it is a product that has been ordered (if it is a product that has not been ordered, do not unpack, open, otherwise it will not be replaced)
* if the product is in new condition or has no obvious defect
* if all its parts are working

The warranty does not cover defects in goods caused by improper use, storage or damage to the goods by the Buyer. The packaging and contents of the product must not be mechanically damaged (mechanical damage is understood to be damage to the product which could not be caused by normal use of the product for the purpose for which it was made).

9. Warranty Conditions and Complaints Procedure
9.1 Home AZ, s.r.o. warns that the information provided on www.home-az.com is partly retrieved from third parties, may contain inaccuracies and may be updated without prior notice.

9.2 Home AZ, s.r.o. may at any time change the products and services described on its site without prior notice and does not guarantee the accuracy of their content.

9.3 Home AZ, s.r.o. it is not liable to another party for direct, indirect or extraordinary damages caused by the use of information from its own or linked websites.

10. Protection of personal data
10.1 Home AZ, s.r.o. processes the following customer’s personal data for the purpose of purchasing goods via e-shop and goods delivery: name, surname, phone number, e-mail address, address, details of purchased goods and data related to payment for goods (account number, amount paid, date crediting the account).

The legal basis for the processing of personal data in the case of the purchase of goods via the e-shop, delivery of goods to the customer and the settlement of claims is Article 6 par. 1 (a) (b) Regulation on the protection of individuals with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46 / EC (General Data Protection Regulation) (hereinafter “the GDPR Regulation”); 1 (a) c) GDPR Regulations.

We protect your data from abuse and we guarantee that we will never provide your third party with your contact information and your purchases.

10.2 By using this online store you agree to collect and use information about you and your purchases under the conditions set out above. By registering a customer, a newsletter subscriber, a poll participant and other forms of registration, you automatically agree that you can be informed about news in our e-mail shop or by phone. If you no longer wish to receive this information, you may opt out at any time by following the steps outlined in each message you send.

10.3 Our online store reserves the right to waive the security guarantee in the event of a server attack by an unknown perpetrator (hacker). In case of a hacker attack we will inform you about the leak of your data.
